How to choose a process server: what to check

A short checklist to protect your matter from a badly handled service.

A badly handled service can cost you months. Before you instruct anyone, run through this list.

1. Are they licensed?

In Queensland, process servers are licensed field agents. The Queensland Government issues them a licence or registration certificate and a photo identification card, which they should have on them when working. Ask to see it, and ask for the licence number.

2. Will they act in the right capacity?

If they are also a bailiff, make sure it is clear whether they are acting as a bailiff or a private process server for your job.

3. Do they keep a record of every attempt?

A written record of attempts is what a court wants to see if service is difficult.

4. Can they provide an affidavit?

Ask whether an affidavit of service is included and what form they use for your court.

5. Do they keep you informed?

You should hear from them after attempts, not just at the end.

6. Do they know the local area?

On the Gold Coast, local knowledge about suburbs, buildings and court locations saves time and cost.

7. Do they protect confidentiality?

Legal documents are sensitive. A good agency is bound by privacy obligations and handles them in confidence.
